This is an action to recover the cost of repairing damage to building and roof joists occasioned by the collapse of some of
the joists during the construction. The plaintiff-appellant, the general contractor (hereinafter plaintiff), commenced action
against defendant-respondent, the engineer and architect of the building (hereinafter defendant), alleging defective plans
and specifications and defective supervision of the project. Defendant answered denying liability and alleging negligence
of the plaintiff as to the procedures used during installation of the roof joists. The case was tried to the court. The trial court found that the cost of replacing and repairing the damage was $36,040, this
cost having been borne by the plaintiff; that the defendant was not negligent either as to design or supervision; and that
the cause of the damage was a deficiency in the construction procedure adopted and used by the plaintiff.
